摘　　要：在21世纪的现在,大数据技术与人民的生活产生了紧密相连的联系,而其中人脸识别技术则是最好的证明。即使它可以为人们提供一定的便利,但是它在日常生活中给人们在一定程度上也带来了无法预知的人身、财产风险。因此,目前社会最为关注的重要法律问题之一就是滥用人脸识别技术对个人信息所造成的侵害。关于人脸识别信息保护首先应认定和分析人脸识别过程中可能侵害权益的现象,才可以进一步探讨法律救济的措施,使受到侵害权益的受害者真正得到损害赔偿。本文主要从人脸识别技术侵权的现象入手,分析侵权法律救济的困境,包括我国立法规范不足,且各法律规范适用的协调性差、监管主体不明确,监管措施混乱和受害人侵权责任的举证困难,然后提出解决方案,比如加强人脸识别立法规制、实现人脸识别技术应用全过程监管和举证责任的倒置。In the 21st century,big data technology has a close connection with people’s lives,and face recog-nition technology is the best proof.Even though it can provide some convenience for people,it also brings unpredictable personal and property risks to people to a certain extent in their daily life.Therefore,one of the important legal issues that society is most concerned about is the abuse of face recognition technology to personal information.The protection of face recognition information should first identify and analyze the phenomenon of possible infringement of rights and interests in the process of face recognition,so that legal relief measures can be further explored,so that the victims of infringement of rights and interests can really get damages.This paper mainly starts with the phenomenon of infringement of face recognition technology,analyzes the dilemma of infringe-ment legal relief,including insufficient legislative norms in China,poor coordination of the applica-tion of various legal norms,unclear regulatory subjects,chaotic regulatory measures and the diffi-culty of proving the victim’s tort liability,and then proposes solutions.For example,strengthening the legislative regulation of face recognition,realizing the supervision of the whole process of face recognition technology application and the inversion of the burden of proof.
