摘　　要：2022年12月1日,《联合国国际货物销售合同公约》(以下简称“CISG”)正式在中国香港生效。自此,中国内地与香港地区两个法域共同适用该公约,成为“一国两制”下国际贸易和法律区域协同的重要事件。然而,由于香港特别行政区的历史与法律地位,其适用CISG的过程存在一些特殊和复杂的法律问题。本文从香港地区的宪制背景出发,分析CISG在香港地区适用的特殊法律问题,包括与内地法律体系的协调、CISG与香港合同法的潜在冲突、司法解释与实践的挑战等。通过探讨香港地区放弃对CISG第1条第(1)款(b)项的保留、仲裁与诉讼中的适用差异等问题,本文提出解决路径,并展望未来香港地区在全球贸易法中的角色和CISG适用的进一步发展。通过深入的法律协调,香港地区不仅能提升其在全球贸易法律体系中的影响力,还能为区域经济一体化和全球贸易规则的制定提供重要保障.On December 1,2022,the United Nations Convention on Contracts for the International Sale of Goods(CISG)officially entered into force in Hong Kong SAR,China.Since then,both China' Mainland and Hong Kong SAR have applied the Convention,marking an important development in the coordination of international trade and legal regimes under the"one country,two systems"framework.However,due to the unique historical and legal status of the Hong Kong Special Administrative Region,the application of the CISG has raised several specific and complex legal issues.This paper begins by exploring the constitutional context of Hong Kong,analyzing the special legal challenges in applying the CISG in the region.These challenges include issues related to the coordination with China' Mainland legal systems,potential conflicts between the CISG and Hong Kong's contract law,and the difficulties in judicial interpretation and practice.By examining issues such as Hong Kong SAR's decision to withdraw its reservation under Article 1(1)(b)of the CISG,and the differences in application between arbitration and litigation,this paper proposes solutions and looks ahead to the future role of Hong Kong SAR in global trade law,as well as the further development of CISG application.Through deeper legal coordination,Hong Kong SAR can not only enhance its influence in the global trade legal system but also provide crucial support for regional economic integration and the development of global trade rules.
