历史建筑保护与活化利用的立法优化——以《山东省历史文化名城名镇名村保护条例》为例

摘　　要：《山东省历史文化名城名镇名村保护条例》是山东针对历史文化建筑保护开展地方立法的阶段性成果,为山东省历史文化建筑的保护与活化利用提供了法律支撑。但仍然存在历史建筑保护责任划分不明确、活化利用制度单一化、历史建筑保护处罚规定有待完善等不足。应当在厘清历史建筑保护主体的责任、坚持保护基础上的地方特色活化利用、完善历史建筑保护处罚规定等方面完善历史建筑保护与利用法律制度,从而为历史建筑的保护与活化利用的协调提供富有地方特色的地方立法。The“Regulations on the Protection of Historical and Cultural Cities,Towns,and Villages in Shandong Province”is a phased achievement of local legislation for the protection of historical and cultural buildings in Shandong Province,providing legal support for the protection and revitalization of his-torical and cultural buildings in Shandong Province.However,there are still some shortcomings in the legal system for the protection and utilization of historical buildings,such as unclear division of responsibilities for their protection,single institutionalization of revitalization,and incomplete regulations on punishment for violations.It is necessary to clarify the responsibilities of the pro-tecting entities,adhere to the local feature-based revitalization of historical buildings,and improve the regulations on punishment for violations to improve the legal system for the protection and uti-lization of historical buildings,thus providing locally characteristic legislation for the coordination of the protection and revitalization of historical buildings.
