数字货币犯罪分析及刑事治理建议

摘　　要：随着信息科技发展,基于区块链技术的数字货币发展迅猛,对传统犯罪产生了深刻影响。数字货币犯罪总体呈现数量逐年递增趋势,同时案件类型多样,特别是数字货币传销犯罪、洗钱犯罪、诈骗犯罪问题高发。其危害程度已超越同领域传统犯罪,极有可能对我国金融体系产生冲击,严重威胁国家稳定。数字货币犯罪刑事治理存在性质认定不清、规范滞后、取证困难等问题。可以从法律属性认定、规范体系建设、侦查及证据固定提取能力提升等方面提出数字货币犯罪的刑事治理建议,构建强有力的涉数字货币犯罪刑事治理体系。With the development of information technology,digital currencies based on blockchain technol-ogy have grown rapidly and have also had a profound impact on traditional crime.The overall num-ber of digital currency crimes is increasing year by year,and the types of cases are diverse,espe-cially those involving digital currency pyramid schemes,money laundering,and fraud.Its level of harm has surpassed traditional crimes in the same field,and it is highly likely to have an impact on China’s financial system,seriously threatening national stability.There are problems in the crimi-nal governance of digital currency-related crimes,such as unclear nature identification,lagging standards,and difficulties in obtaining evidence.Suggestions for criminal governance of digital cur-rency crimes can be proposed from the aspects of legal attribute recognition,normative system con-struction,investigation,and improvement of evidence extraction capabilities,in order to build a strong criminal governance system for digital currency crimes.
