公安机关执法办案管理中心推行侦查大部制的思考——以犯罪治理系统观为视角

摘　　要：公安机关执法办案管理中心是“市县主战”公安机制改革和深化警务作战机制改革的重要载体。当前执法办案管理中心一体化作战面临着主体力量薄弱、犯罪系统性治理不够、犯罪类别化治理向系统性治理不到位、侦查信息需求与警种数据供给之间的矛盾尚未得到有效缓解等诸多挑战。以网络新型犯罪为代表的犯罪活动呈现出犯罪要素扩张、犯罪生成条件不断强化、犯罪风险提升的趋势,这对公安机关“专业打职业”作战提出了更高要求。因此,应以犯罪治理系统观为指导和方法论,建构执法办案管理中心侦查大部制基本理论与实践框架,建立公安机关主导的多部门共同治理的“一站式”大侦查工作格局,形成犯罪全要素整体治理,运用警务融治作战策略,全面提升公安机关新质战斗力。The Law Enforcement and Case Management Center of the Public Security Organs is an important carrier for reforming the"Proactive City and County"public security mechanism and deepening the reform of the police operation mechanism.The integrated operation of the current law enforcement and case management center is facing challenges of weak main forces,insufficient systematic governance of crimes,inadequate transition from categorized governance to systematic governance of crimes,and the fundamental contradiction between the demand for investigation information and the data supply from different police branches.Crime activities,represented by new types of cybercrime,are showing trends of expanded criminal elements,continuously strengthened conditions conducing crimes,and increased crime risks,which poses higher demands on the public security organs'strategy of"combat organized crime with professionalism".Guided by a systematic approach and methodology,we will construct the basic theoretical and practical framework of the investigation department system in the law enforcement case management center,establish a"one-stop"large-scale investigation work pattern led by public security organs and jointly governed by multiple departments,form a comprehensive governance of all elements of crime,and comprehensively enhance the new quality combat effectiveness of public security organs.
