摘　　要：《反有组织犯罪法》是反有组织犯罪工作法治化的里程碑,追求打击有组织犯罪和保障人权并重;但从与《联合国打击跨国有组织犯罪公约》相衔接的角度,尚值得进行权利保障方面的检视。该法对有组织犯罪人创新性地设置了技术侦查手段以及行刑后监管措施,但未作具体细化规定,对有组织犯罪的违法所得处置容易出现责任划分不明等困境,导致实施中难免出现侵害权利之虞。相应地,应当着力从犯罪人维度来完善其权利保障体系,主要包括对犯罪人的侦查手段应坚持合比例性要求,在违法所得处置中尊重犯罪人的财产权利,对行刑后监管措施进行区别性适用和合理救济。The Anti-Organized Crime Law is a milestone in the legalization of anti-organized crime work,which emphasizes both crime combating and human rights protection.However,from the point of view of its connection with the United Nations Convention against Transnational Organized Crime,the Anti-Organized Crime Law deserves to be reviewed and examined in terms of the protection of rights.The Law has innovatively provided the technological investigation means and the post-execution supervision measures for criminals of organized crimes,though no specific provisions relating to them have been made;also,it is easy to meet difficulties in the disposal of illegal proceeds of organized crime,such as unclear division of responsibilities and therefore it is difficult to exclude the possibility of infringing rights in its implementation.Accordingly,efforts should be made to improve the rights protection system from the dimension of criminals,which include the following:the means of technological investigation of criminals should meet the requirement of proportionality,the property rights of criminals should be respected in the disposal of illegal income and differentiated application and reasonable relief should be given to the post-execution supervision measures.
