摘 要:根据我国现行劳动法律制度,劳动权益保障以劳动者与企业之间存在劳动关系为前提,而劳动关系的认定则以是否存在人格从属性、组织从属性、经济从属性为衡量标准,即从属性标准。从属性标准产生于工业时代,适用于工业时代。然而,在当前的数字平台经济中,企业招录劳动者的方式多采用注册制,劳动过程管理更多地依赖于技术手段而非传统管理人员,且收入模式常以收入分成替代传统工资制。这一系列变化使得传统的从属性标准难以准确判断数字平台企业与劳动者之间是否存在实质性的劳动关系。因此,必须创新劳动从属性标准,以便准确识别平台企业与劳动者之间的劳动关系,从而有效保障数字平台企业劳动者的合法权益。According to the current labor law system in China,the protection of labor rights and interests is based on the existence of a labor relation between workers and enterprises,and the labor relation is determined by personal subordination,organization subordination,and economic subordination,which constitutes the subordination criteria.The subordination criteria originated and were applicable in the industrial age.However,in the current digital platform economy,enterprises predominantly adopt a registration-based recruitment system,implement labor process management through technological means rather than traditional management personnel,and tend to utilize revenue-sharing models instead of conventional wage systems.These changes make it difficult to accurately determine whether there is a substantive labor relation between digital platform enterprises and workers.Therefore,it is necessary to innovate the subordination criteria to overcome the aforementioned shortcomings,thereby effectively protecting the legitimate rights and interests of workers in the digital platform economy.
