论涉外法治人才培养中案例原文教学法的引入

摘　　要：党的二十届三中全会通过的《中共中央关于进一步全面深化改革推进中国式现代化的决定》再次强调要加强涉外法治建设。涉外法治人才是涉外法治建设的重要基础和根本保障。涉外法治人才培养具有鲜明的实践导向,因此案例教学法具有重要的价值。然而,美式判例教学法、法律诊所、德式鉴定式案例法及个案全过程教学法均有各自的局限性,与涉外法治人才培养难以完全适配,应在法学双语课中引入案例原文教学法。案例原文包括国际法和重要的国别法案例原文;教学时应采用“讲解+追问式讨论”,通过课前课中课后三个环节实现优化和完善课程教学内容,法学专业知识与语言技能一站式获取,实体法知识、程序法知识与其他背景知识一体化习得,理论知识与实践素养同步提升的教学目标。"Resolution of the Central Committee of the Communist Party of China on Further Deepening Reform Comprehensively to Advance Chinese Modernization"approved in The Third Plenary Session of the 20th Central Committee of the Communist Party of China once again emphasized the need to strengthen the construction of foreign-related legal systems.The cultivation of talent in foreign-related legal fields is an essential foundation and fundamental guarantee for building such systems.In legal education,the case teaching method holds significant practical value.However,the American case method,legal clinics,the German evaluative case method,and the whole-process individual case teaching method all have their limitations and do not fully align with the needs of training talent for foreign-related legal fields.Based on this,the introduction of the original case teaching method in bilingual law courses is recommended.Extraterritorial cases not only include international law cases,but also include national law cases of important countries.Teachers should adopt a"detailed explanation and probing discussion"approach,optimizing and enhancing course content through pre-class,in-class,and post-class stages.This approach aims to enable the one-stop acquisition of specialized legal knowledge and language skills,integrated learning of substantive and procedural law knowledge along with interdisciplinary background knowledge,and the simultaneous advancement of theoretical understanding and practical competence.
