中国环境法价值的生成逻辑与体系建构

摘　　要：确立中国环境法价值体系,是建构中国自主的环境法学知识体系的重要内容,也是编纂《生态环境法典》的内在需求。从广义上阐释环境法律规范出发,中西方从古代农业社会、近代西方工商社会、现代风险社会中逐渐发展的环境法,经历了作为主体的人顺应自然、物化自然到接受可持续发展的价值观的历史演进。当前我国对于环境法价值这一基础性理论命题的研究与界定重视不足,建构中国环境法价值体系应当坚持马克思主义立场观点和方法、传承中华传统优秀生态智慧与生态文化,重视并体现立体型价值体系的理论属性。中国环境法的价值体系包括目的性价值和工具性价值,目的性价值为可持续发展,工具性价值应当在与传统法律价值的比较中厘清、在与域外环境法价值的比较中创新。Establishing the value system of Chinese environmental law is a crucial component in building China s independent knowledge system of environmental law and serves as an inherent requirement for the compilation of the Ecological Environment Code.From a broad interpretation of environmental legal norms,environmental law has evolved through various stages—from ancient agricultural societies to modern industrial and commercial societies in the West,and finally to contemporary risk societies.This evolution reflects a historical progression in values:humans,as subjects,initially adapted to nature,then sought to dominate it,and ultimately embraced the concept of sustainable development.Currently,there is insufficient emphasis on the research and definition of the fundamental theoretical proposition regarding the value of environmental law in China.Constructing the value system of Chinese environmental law should adhere to Marxist perspectives and methodologies,inherit the rich ecological wisdom and culture of traditional Chinese thought,and highlight the theoretical attributes of a multi-dimensional value system.The value system of Chinese environmental law encompasses both teleological values and instrumental values.The intrinsic value is sustainable development,while the instrumental values should be clarified through comparisons with traditional legal values and innovated through comparisons with the values of environmental laws from other countries.
