论国家公园法的整体性治理进路

摘　　要：国家公园法应以生态保护为主旨,明确其在法律体系中的定位,贯彻整体性保护理念。在理念基础方面,国家公园法应贯彻可持续发展理念,体现“以保护生态系统功能为核心的整体性”和“保障合理民生需求的可持续性”两大要点。在规范内容方面,国家公园法应在遵循保护优先原则的前提下,妥善处理人地关系,保障合理的民生需求,实现两者之间的动态利益衡平。在法治体系建构方面,国家公园法作为自然保护地法律体系的重要组成部分,应当在实现政策语言转化的基础上,建立生态—经济双向耦合的制度体系,并推动法律规范体系的有序衔接,从而实现以可持续发展理念为指引的体系协同。The National Park Law should prioritize ecological conservation,clarify its systemic positioning within the legal framework,and implement holistic protection principles.The National Park Law should adopt the idea of sustainable development,emphasizing two core tenets:a“holistic approach centered on ecosystem function conservation”and“sustainability safeguarding legitimate livelihood needs.”In terms of normative content,the law should have adhered to the principle of eco-prioritizing protection,while appropriately managing the relationship between humans and nature,safeguarding reasonable livelihood needs,and achieving a dynamic balanced of interests between the two.In terms of legal system construction,as an important component of the legal system for nature protected areas,the National Park Law should have established an institutional framework for the two-way coupling of ecology and economy based on the transformation of policy language into legal norms,and implemented a unified legal order within the legal norm system,thus achieving system coordination guided by the concept of sustainable development.
