国家公园生态环境检察管辖机制研究——以四川大熊猫国家公园为例

摘  要:《国家公园法(草案)》在司法保护层面仍存在空白,应当在国家公园法中明确国家公园建设的司法保障机制,健全国家公益生态环境检察管辖机制建设。以四川大熊猫国家公园为例,园内检察系统经历了属地管辖、集中管辖到“半集中管辖”三种生态环境检察管辖模式,但分别存在“专业性”和“刚性与尺度”问题、“失衡”与“减效”问题以及检察监督目的落空风险。对此,实践中检察系统应变被动为主动,创新生态环境检察管辖机制和工作机制。可考虑分区设立“国家公园生态环境检察院”,建立“适度集中管辖”的生态环境检察诉讼“一体化”创新工作机制,强化国家公园内的生态环境检察职能。There are still gaps in the National Parks Law(Draft)at the level of judicial protection.It is imperative to establish a judicial safeguard framework for national park development within the National Park Law and enhance the national public interest ecological and environmental procuratorial jurisdiction mechanism.Taking Sichuan Giant Panda National Park as a case study,the park’s procuratorial system has undergone three models of ecological and environmental procuratorial jurisdiction:territorial jurisdiction,centralized jurisdiction,and“semi-centralized jurisdiction”.However,these models respectively present challenges including issues of“professionalism”versus“rigidity versus flexibility”,problems of“imbalance”and“efficiency reduction”,as well as risks of undermining procuratorial oversight objectives.In response,the procuratorial system should transition from passive to proactive approaches,designing innovative jurisdiction mechanisms and ecological environmental procuratorial working methods that better align with prosecutorial logic.Proposed reforms include establishing zoned“National Park Environmental Procuratorates”and implementing an integrated litigation framework through“moderately centralized jurisdiction”,thereby enhancing environmental prosecutorial efficacy within national parks.
