新业态职业群体面临的工伤保险法律问题研究

摘　　要：新业态经济催生了大量新的职业选择,造就了一批新业态职业群体,有助于激发市场经济活力、扩大劳动就业市场规模。然而,新业态职业群体在工伤保险法律适用方面存在诸多难题,他们在遭受意外伤害时可能难以享受工伤权益保障。为切实维护新业态职业群体的工伤保险权益,提出解绑工伤保险与劳动关系、确保工伤认定的灵活性、落实工伤保险的征缴筹集以及确定科学合理的工伤待遇等建议,希望能减少新业态职业群体的职业风险。The new business model economy has given birth to a large number of new career choices and created a group of new business model occupational groups, which helps to stimulate the vitality of the market economy and expands the scale of the labor employment market. However, there are many difficulties in the application of work-related injury insurance laws for new occupational groups, and they may find it difficult to enjoy work-related injury rights protection when they suffer from accidental injuries. To effectively safeguard the work-related injury insurance rights and interests of new occupational groups, suggestions have been put forward to unbind work-related injury insurance from labor relations, ensure flexibility in work-related injury identification, implement the collection and fundraising of work-related injury insurance, and determine scientific and reasonable work-related injury benefits, hoping to reduce the occupational risks of new occupational groups.
