摘　　要：数字经济作为当今经济发展的重要驱动力,正在深刻改变传统产业和商业模式。然而,随着数字经济快速发展,法律挑战愈加突出,包括数据隐私保护、知识产权、反垄断和网络安全等问题。这些问题不仅影响企业运营效率,也制约数字经济健康发展。文章回顾国内外数字经济相关法律法规的发展历程,分析不同国家在数字经济立法方面的经验与教训,提出建立健全数字经济法律体系的建议,包括加强数据保护立法、完善知识产权保护机制和优化反垄断政策。全面分析这些法律问题,旨在为相关决策者提供有价值的政策建议,为未来数字经济法律框架建设提供理论依据与实践指导,以促进我国数字经济规范发展和可持续增长。The digital economy,as an important driver of today’s economic development,is profoundly changing traditional industries and business modes.However,with the rapid development of digital economy,legal challenges have become more prominent,including issues such as data privacy protection,intellectual property rights,antitrust and cybersecurity.These issues not only affect the operational efficiency of enterprises,but also restrict the healthy development of the digital economy.This paper reviews the development history of laws and regulations related to the digital economy at home and abroad,analyses the experience and lessons learned from different countries’digital economy legislation,and puts forward proposals for establishing a sound legal system for the digital economy,including strengthening data protection legislation,improving intellectual property protection mechanisms and optimising anti-monopoly policies.By comprehensively analyzing these legal issues,the study aims to provide valuable policy recommendations for relevant policymakers as theoretical basis and practical guidance for the construction of future legal framework of digital economy to promote the standardized development and sustainable growth of China’s digital economy.
