摘　　要：法家一词天然包含“法”的属性,是研究中华优秀传统法律文化的窗口。回归法家传世经典文献解读,应成为汲取中华优秀传统法律文化精华的正确方式。南齐文献《上新定法律表》是法家学派的传世经典,但其法学价值却被忽视与低估。在奏表中,孔稚珪通过对南齐律法《永明律》内容的提炼与总结,提出了“驭大国者以法理为本”的古典法治思想。从“法理为本”这一思想内核出发,《上新定法律表》相继论述了法的作用、法的价值、法学教育等系列法治主张。以古方今,法家经典文献具有丰富的民族共同体法治建构的古典智慧,对新时代法治铸牢中华民族共同体意识具有重要启示。这些启示主要包括通过“以小到大”着手、“从无到有”推进、“由浅入深”升华三方面,合力推动中华优秀传统法律文化在具体领域的创造性转化和创新性发展。The term“Legalism”intrinsically embodies the essence of“law”and functions as a key vantage point for exploring China’s remarkable traditional legal culture.Returning to the in-depth interpretation of classic Legalist works is an appropriate route to extract the quintessence of China’s outstanding traditional legal heritage.Shang Xinding FalǜBiao,a classic Legalist document,has unfortunately seen its legal value overlooked and underestimated over time.In his memorial,kong Zhi-gui,through meticulous refinement and summary of the Yongming Law of the Southern Qi Dynasty,put forward the classical rule of law ideology:“The ruler of a great nation should take legal principles as the bedrock of governance.”Centered on this core idea,Shang Xinding FalǜBiao elaborates on a series of legal propositions covering the role of law,the value of law,and legal education.By juxtaposing the past and the present,Legalist classical literature reveals rich classical wisdom in national governance through law.A scientific exegesis of these texts offers valuable insights for constructing the rule of law within the Chinese national community.These insights involve gradually expanding from the small to the large,evolving from non-existent to existent,and advancing from the shallow to the profound,thereby jointly facilitating the creative transformation and innovative development of China’s outstanding traditional legal culture in specific fields.
