摘  要:在当前全国各高等院校对聘用教师逐步实行去事业编制政策的背景下,高校教师聘用合同蕴含非升即走的“服务期”制度已间接引发多起社会焦点事件。本质原因在于高校和教师约定的“服务期”条款,无法纳入现有法律法规规范范围,其本身也在约定事项、服务期限、违约金额等方面存在诸多不合理之处。这也是此制度在实践中产生诸多争议的根源所在。另外,高校对聘用合同“服务期”制度的运用,已然偏离我国进行高等院校聘用制改革的最终目标方向,需从理论入手阐释,以纠正实践偏差。为充分发挥“服务期”制度在高等院校人事改革、遴选优质科研人员中的重要助推作用,可从规范约定事项范围,限制违约支付金额、合理确定服务期限以及完善教师的预告解除权等路径,对其进行优化。Under the background that colleges and universitiesin China have gradually implemented the policy of the removal of teachers' authorized strength, the “service period” system contained in the employment contract of college teachers has indirectly caused many social issues. The essential reason is that the “service period” clause agreed by universities and teachers cannot be incorporated into the scope of existing laws and regulations, and there are many unreasonable aspects in terms of the agreed items, service period, and amount of default. This is also the rooted cause of many disputes in practice. On the other hand, the application of the “service period” system of employment contract in colleges and universities has deviated from the ultimate goal direction of the reform of employment system in colleges and universities in China, which needs to be explained theoretically to correct the practical deviation. In order to give full play to the important role of the “service period” system in personnel reform and selection of high-quality scientific researchers in colleges and universities, it can be optimized by standardizing the scope of agreed matters, limiting the amount of default payment, reasonably determining the service period and perfecting the teachers' right to terminate the notice.
