轻罪时代下犯罪附随后果研究

摘　　要：当前,犯罪附随后果的适用与轻罪治理的需求相违背。其适用随意性强、严厉程度高、波及范围广泛使之呈现惩罚过重的属性,阻碍着犯罪治理现代化的发展。探究其原因在于相关规定违背宪法精神、犯罪附随后果的性质认定模糊、实践中混淆罪行与犯罪人表现要素。对于犯罪附随后果存在的问题,应当坚持预防为主,惩罚为辅的适用精神。在具体制度层面,前科消灭制度的对象应实现大面积覆盖,启动时间可借鉴追诉时效制度并附加相对的犯罪记录封存制度,启动程序上兼采职权与申请模式,以此激励恢复性司法与被遗忘权在社会观念中的正确体现并引领对于前科者的正确评价,助于服刑完毕人员的社会复归.At present,the application of criminal consequences is contrary to the need for mitigating minor offenses.Its strong arbitrariness,high severity,and wide range of impact make it exhibit the attribute of excessive punishment,which hinders the development of modern crime governance.The reasons for this are that the relevant regulations violate the spirit of the Constitution,the nature of the accompanying consequences of the crime is ambiguous,and in practice,the elements of the crime and the perpetrator's performance are confused.For the problems of accompanying consequences of crimes,we should adhere to the spirit of prevention first and punishment as a supplement.At the specific institutional level,the target of the criminal record elimination system should be widely covered,and the initiation time can draw on the statute of limitations system and attach a corresponding criminal record sealing system.In terms of initiation procedures,both powers and application models should be adopted to encourage the correct reflection of restorative justice and the right to be forgotten in social concepts,and to lead the correct evaluation of criminal record holders,helping to facilitate the social reintegration of those who have completed their sentences.
