摘 要:现有研究大多认为部门隶属于政府,强调跨部门协同有利的一面,忽视了共享资源、服务或技术的同时也可能将法定职权转交给了未获授权的部门。一些不合理行政行为的症结在于不合理的部门间关系,需要修正整体政府理论的内涵,建构行政权的部门结构。行政组织法的目的在于维护适度分工的部门间关系,避免部门因控制特定职权而在所有领域都有支配性,提升决策的专业品格,分散单个部门错误决策的风险。协同过度和不足均有问题,应对跨部门协同设定以下界限:部门在处理专业能力能胜任的主管事项时,不应当与其他部门协同,避免功能完全一体;当监管问题棘手,需要其他职能配套时,主管部门应当与其他更具专业能力的部门协同。协同不能混淆责任,对外行政责任是一体的,对内应将责任区分到部门。Existing research views government departments primarily as subordinate entities within the administrative hierarchy, focusing on the benefits of interdepartmental collaboration. However, it often overlooks the risks of transferring statutory authority to unauthorized departments through shared resources, services, or technology. Unreasonable administrative actions often stem from dysfunctional interdepartmental relationships rather than from mistakes made by a single department. While departmental silos and fragmented governance undermine administrative efficiency and require reform, the potential drawbacks of excessive interdepartmental collaboration also deserve careful consideration. This calls for a reflection of the Whole-of-Government Theory. The objective of administrative organization law is to maintain appropriately differentiated interdepartmental relationships and prevent any one department from dominating all domains due to its control over specific powers. Interdepartmental collaboration should not be aimed at amplifying the influence of a single department;if that were the case, collaboration would be unnecessary. Much like a healthy immune system that identifies and eliminates pathogens, moderate interdepartmental collaboration should integrate diverse expertise, enabling decision-makers to consider a broader range of relevant factors. This enhances the scientific rigor of decisions and mitigates the risks associated with errors by individual departments. However, increasing the frequency or extent of collaboration does not necessarily result in better governance. When interdepartmental collaboration becomes overly generalized, it can provoke internal conflicts that are difficult to resolve, similar to an immune system overreacting and attacking healthy cells. In their pursuit of consensus, departments may become overly reliant on others, neglecting their own professional judgment and compromising their independence.
