摘  要:自动驾驶技术的快速发展对现行交通事故责任认定及保险制度构成了严峻挑战。本文分析了现行法律在责任主体划分、归责原则适用及因果关系认定方面的局限性,探讨了交强险、商业险、保险费率评估、投保主体在自动驾驶汽车模式下的无法量化技术风险,导致保费与实际风险脱钩问题,提出了完善强制保险制度、引入多元化保险模式、优化风险评估机制以及设立赔偿基金等措施,旨在为完善自动驾驶法律框架和保险体系提供理论支持,以推动技术应用与法律制度的协同演进。The rapid development of autonomous driving technology poses a serious challenge to the current traffic accident liability determination and insurance system. This paper analyzes the limitations of the current law in the division of the responsible subject, the application of the principle of attribution and the determination of causality, discusses the unquantifiable technical risks of compulsory insurance, commercial insurance,insurance rate assessment, and the subject of the insurance policy under the mode of self-driving cars, resulting in the problem of decoupling of the premiums from the actual risks, and proposes measures such as perfecting the mandatory insurance system, introducing a diversified insurance model, optimizing the risk assessment mechanism, and setting up a compensation fund. fund and other measures, aiming to provide theoretical support for the improvement of the legal framework and insurance system of autonomous driving, in order to promote the synergistic evolution of technology application and legal system.
