摘　　要：构建独立的体育调解机制不仅是顺应国际趋势的必然选择,还是推动体育纠纷解决机制发展的应然之策。然而,目前我国尚不具备构建独立体育调解机制的立法环境。为此,可充分借鉴商事调解模式,在《体育仲裁规则》已确立仲裁庭中调解机制的基础上,制定《体育仲裁调解规则》,细化既有程序,满足当下体育纠纷解决需求。随后修订《体育仲裁规则》,为仲裁庭外相对独立的调解提供制度依据,并制定《中国体育仲裁委员会调解规则》,初步搭建包括仲裁、仲裁中调解、仲裁外调解在内的多元纠纷解决机制。在制度建构过程中,应充分考虑体育纠纷的特殊性,在范围上排除体育纪律性纠纷,兼采分析式和协助式的调解方式,并通过程序规则规避中立性风险。The construction of an independent sports mediation mechanism is not only an inevitable choice in line with international trends,but also a natural way to promote the development of sports dispute resolution mechanisms.However,at present,China does not have the legislative environment to build an independent sports mediation mechanism.In this regard,we can fully draw on the commercial mediation model,and on the basis of the mediation mechanism in the arbitration tribunal established in the Sports Arbitration Rules,formulate the Sports Arbitration Mediation Rules to refine the existing procedures and meet the current demand for sports dispute resolution.Subsequently,the Sports Arbitration Rules were revised to provide a systematic basis for relatively independent mediation outside the arbitration tribunal,and the Mediation Rules of China Sports Arbitration Commission were formulated to initially build a multi-disciplinary dispute resolution mechanism including arbitration,mediation in arbitration and mediation outside arbitration.In the process of constructing the system,full consideration should be given to the special characteristics of sports disputes,excluding sports disciplinary disputes from the scope,adopting both analytical and facilitated mediation,and avoiding the risk of neutrality through procedural rules.
