摘　　要：诈骗罪中被害人处分财产性利益的行为认定需从财产性利益与“财物”的关系出发,确认财产犯罪行为对象的“财物”是否包含财产性利益。根据物理管理可能性说及债本身的特征,可判断部分原权之债属于财产性利益。构成对财产性利益的诈骗需要从被害人的角度出发,考察其是否存在处分行为与处分意识。处分行为主要表现为被害人利益损失时行为人或者他人利益的增加。在诈骗罪的构成中,被害人的处分意识是连接行为人欺骗行为与被害人处分行为的重要依据,需判断被害人对处分行为是否具有相应的处分意识,在对财产性利益的范围存在认识错误的情形中,被害人对超出的范围不存在处分意识;在对财产性利益的价值存在认识错误的情形中,被害人具有处分意识。To determine the victim′s disciplinary action of property interest in fraud,it is necessary to start from the relationship between the property interest and the "property",so as to ensure whether the "property" is the object of the criminal act of property which includes the property interest.According to the theory of the possibility of physical management and the characteristics of the debt itself,it can be judged that part of the original right of the debt is a property interest.It is necessary to start from the victim′s point of view for fraud composition of property interests to examine whether there is disciplinary action and disciplinary awareness.Disciplinary action is mainly manifested in the loss of the victim′s interests when the interests of the perpetrator or others increase.In the composition of fraud,the victim′s disciplinary awareness is an important basis for connecting the perpetrator′s fraudulent behavior and the victim′s disciplinary action.It is necessary to determine whether the victim has disciplinary awareness of disposition:in cases where there is a misunderstanding of the scope of the property interest,the victim does not have disciplinary awareness to the exceeding scope;in cases where there is a misunderstanding of the value of the property interest,the victim has disciplinary awareness.
