网络儿童“性引诱”的域外法律规制及启示

摘　　要：目前互联网已成为儿童性侵害的新媒介,网络儿童“性引诱”现象较为突出。犯罪学最新研究显示,网络儿童“性引诱”的实质是以建立一种稳定可靠的关系为手段,以便在未来通过实际接触的方式对儿童实施性侵犯。从刑法学的角度看,性引诱属于强奸或猥亵儿童罪的犯罪预备行为。多国法律已明确将儿童性引诱行为纳入刑事制裁范围。我国则以扩张猥亵儿童罪的适用作为应对策略,最高法发布的将“隔空猥亵”认定为猥亵儿童罪的指导案例及相关司法解释即为典型例证。然而,该策略存在预备犯普遍处罚依据的正当性疑问、猥亵的“口袋罪化”倾向等不足。更为妥当的做法是在猥亵儿童罪中单独设立一款,将网络儿童“性引诱”行为单独在刑法中予以规制。在对性引诱犯罪中犯罪人的性犯罪意图进行证明时,可采取“实质性步骤”标准。有必要对我国儿童性犯罪的法律规制进行整合与完善,围绕性虐待、性剥削、儿童色情、性引诱等不同性权利侵害行为制定一部专门的儿童性权利保护法。The internet has become a new medium for sexual assault on children,and the phenomenon of "online child grooming" has become prominent.The latest research in criminology shows that the essence of online child grooming is to establish a stable and reliable relationship as a means to sexually assault children through actual contact in the future.From the point of view of criminal law,online child grooming is clearly a preparation for the crime of rape or child molestation.Many countries have explicitly included online child grooming as a criminal sanction in laws.The common practice in China is to expand the application of the crime of child molestation,which is highlighted by the guiding case of determining "cross-space molestation" as constituting the crime of child molestation issued by the Supreme Court.However,there are some shortcomings in adopting this approach,such as the legitimacy of the basis for the general punishment of the preparatory crime and insufficient tendency of "pocket crime" of molestation.A more appropriate response is to regulate online child grooming in a separate article of the crime of child molestation in criminal law.The "substantial steps" standard can be adopted to prove the intention of the offender to commit a sexual crime in the crime of sexual solicitation.It is necessary to integrate and improve the legal regulation of sexual crimes against children in China,and formulate a special child sexual right protection law centering on different sexual right violations such as sexual abuse,sexual exploitation,child pornography and sexual seduction.
