论轻罪治理的政策面向与多元路径——以行刑反向衔接为视角

摘　　要：以“醉驾”为代表的轻罪治理取得了一定成效,但在实际运行过程中仍存在理论与实践的多重疑虑,由此引发“行刑反向衔接不畅”的实然困境,致使轻罪治理的现实境遇与理想定位相差甚远。《关于办理醉酒危险驾驶刑事案件的意见》已呈现出明显的政策转向和调控意蕴,结合轻罪设置的重心转变和轻罪治理的目标要求,未来的刑事政策转向可概括为:从“治罪”到“治理”、从法益侵害到秩序违反、从宽严相济到分层分类治理。据此,轻罪治理,须在刑法之外谋求多元的治理路径,在入罪和出罪两端综合施策,既要避免过度惩处,更要避免“不刑不罚”,致力于完善行刑反向衔接机制,从而构建行政执法与刑事司法的闭环治理体系。The governance of misdemeanors represented by"drunk driving"has achieved some results,but there are still many concerns in theory and practice in the actual operation process,which has led to the real dilemma of"poor reverse connection of administrative law and criminal law",resulting in a wide gap between the actual situation and the ideal positioning of misdemeanor governance.The Opinion on Handling Criminal Cases of Drunk and Dangerous Driving has shown obvious policy shifts and regulatory implications.In consideration of the shift in the focus of light crimes and the requirements of light crime governance,the future criminal policy shifts can be summarized as:from"punishment"to"governance",from infringement of legal interests to violation of order,and from leniency and severity to hierarchical and classified governance.Therefore,in terms of minor offense governance,it is necessary to seek diverse governance paths outside of criminal law,and implement comprehensive measures at both criminalization and decriminalization.We must not only avoid excessive punishment,but also avoid no punishment,and strive to improve the reverse connection mechanism between administrative law and criminal law,thereby building a closed-loop governance system between administrative law enforcement and criminal justice.
