积极老龄化视域下居家养老责任体系的省思与重塑

摘　　要：我国正在构建以居家养老为基础的多样化养老服务体系,但法律法规的不完善制约着居家养老服务质量的进一步提升。积极老龄化视域下,通过对《中华人民共和国老年人权益保障法》和36份地方居家养老服务条例中责任条款的研读,发现当前立法存在责任主体不清晰、责任分担不合理、责任内容不明确和追责程序不健全等问题。健全居家养老责任体系,宏观层面需贯彻积极养老理念,以健康为基础、以参与为核心、以保障为手段,让老年人有尊严、高质量地养老;微观层面应围绕居家养老服务给付受益者、给付承担者、给付提供者之间的法律关系,从构建完整生命周期服务体系和细化老年人分级分类服务的角度出发,实现责任主体法定化、责任划分合理化、责任内容积极化以及追责程序健全化。China is building a diversified elderly care service system with home-based elderly care as its foundation,but the imperfections in laws and regulations constrain the further improvement in the quality of home-based elderly care services.From the perspective of active aging,this study examines the responsibility provisions in the Law on Protection of the Rights and Interests of the Elderly of China and 36 local regulations on home-based elderly care services.It is found that there are problems in the current legislation,such as unclear responsibility subjects,unreasonable responsibility distribution,ambiguous responsibility content and inadequate accountability procedures.To improve the home-based elderly care responsibility system,the concept of active ageing should be implemented at the macro level,with health as the basis,participation as the core,and protection as the means,so that the elderly can age with dignity and high quality.At the micro level,the legal relationship between the beneficiaries,payers and providers of home-based elderly care services should be addressed.It is necessary to construct a complete life-cycle service system and refine the services for the elderly in a graded and classified manner,so as to realize legal responsibility subjects,rational responsibility distribution,positive responsibility content,and sound accountability procedures.
