摘　　要：数字经济时代,现有公私法在应对源于市场结构失衡的隐私损害问题上存在缺口,此时,作为以恢复自由市场竞争秩序为宗旨的反垄断法介入存在必要性和正当性。个人信息具有货币属性、竞争属性和基本权利性质,应当作为消费者福利的核心内容之一予以独立保护。在个人信息保护问题上,有赖于公私法协动体系的构建,在这一体系中,反垄断法的介入应当以竞争损害为限,以恢复正常的市场竞争秩序为纯粹公私法规范发挥作用创造良好环境和促进企业之间就用户隐私保护水平的竞争以达到不断提高隐私保护水平上限的效果为目的,坚持以分层式规制和“环境完整性”为总体思路,落实个人信息保护竞争政策并借助结构性分离救济措施有效缓解市场结构失衡,从而为个人信息保护填补上市场规制的缺口。In the era of digital economy,there is a gap in the existing public and private laws to deal with the privacy damage caused by the imbalance of market structure.At this time,it is necessary and legitimate for the anti-monopoly law to intervene as the purpose of restoring the free market competition order.Personal information has the property of money,competition and basic rights,and should be independently protected as one of the core contents of consumer welfare.On the issue of personal information protection,it depends on the construction of a cooperative system of public-private law.In this system,the intervention of anti-monopoly law should be limited to the damage of competition,and the purpose is to restore the normal market competition order,create a good environment for the pure regulation of public-private law to play its role,and promote the competition between enterprises on the level of user privacy protection so as to continuously raise the upper limit of the level of privacy protection.Adhere to the hierarchical regulation and"contextual integrity"as the overall idea,the implementation of personal information protection competition policy and the use of structural separation relief measures to effectively alleviate the imbalance of market structure,so as to fill the gap in market regulation for personal information protection.
