摘 要:添附制度作为所有权取得的一项基本制度,不仅在财产分配中可以发挥作用,还具有重要的方法论意义。将添附制度的理论框架适用于知识产权问题,可以为知识产权法律制度提供新的理解视角,也能够为知识产权问题提供新的解答路径。具体而言,在物权效果上,添附理论通过对知识产权的分配,实现“物尽其用”之目的;在债权效果上,添附理论通过补偿或赔偿机制,达成不同主体之间的利益平衡关系。添附理论通过物权效果与债权效果的精密配合,可以在促进智力成果充分利用的同时,有效地平衡创新者与原始创作者的利益,从而进一步推动我国知识产权事业的发展。此外,通过将添附理论适用于知识产权问题,可以进一步挖掘和深化这一制度的理论内涵,进而提升其在现代法律体系中的适用性。As a fundamental mechanism for acquiring ownership,the doctrine of accession not only plays a role in property allocation but also holds significant methodological value.Applying the theoretical framework of accession to intellectual property issues provides a novel perspective for understanding intellectual property law and offers alternative solutions to complex problems in this field.Specifically,from the perspective of property law,accession theory facilitates the optimal utilization of intellectual property by allocating rights to ensure the efficient use of resources.From the perspective of obligations,it strikes a balance of interests among different parties through mechanisms such as compensation or restitution.By harmonizing property effects and obligation effects,accession theory promotes the full utilization of intellectual achievements while effectively balancing the interests of innovators and original creators,thereby fostering the development of intellectual property in China.Furthermore,extending accession theory to intellectual property issues enriches and deepens the theoretical connotations of this doctrine,enhancing its applicability within modern legal systems.
