论第一次侦查讯问前准备工作的时间起点

摘　　要：第一次侦查讯问前准备工作是否及时、充分,对于保障侦查机关讯问工作顺利进行具有重要作用。然而,对于第一次侦查讯问前准备工作的起始时间,学界尚未进行详细探讨。采用对比分析方法,针对学界通常意义上的“犯罪嫌疑人到案说”及实践中部分侦查人员主张的“犯罪嫌疑人抓捕说”进行评价,提出确认犯罪嫌疑人之时作为讯问前准备工作起始时间最为合理。确认犯罪嫌疑人和抓捕、讯问犯罪嫌疑人二者具有内在一致性,确认犯罪嫌疑人是抓捕、讯问犯罪嫌疑人的前置环节。确认犯罪嫌疑人之时开展讯问前准备工作既能充分考虑抓捕前侦查取证工作对讯问犯罪嫌疑人的重大影响,又兼顾抓捕犯罪嫌疑人和同步外围调查取证对讯问犯罪嫌疑人的积极影响,对于侦查机关掌握讯问主动权,及时有效开展第一次讯问,具有重要意义。The timely and sufficient preparation for the first investigation and interrogation plays an important role in ensuring the smooth progress of the interrogation of the investigative organ.However,the academic community has not yet conducted a detailed discussion on the starting time of the preparation for the first investigation and interrogation.This paper adopts the method of comparative analysis to reflect and evaluate the“theory of suspect’s presence”in the common sense of the academia and the“theory of suspect’s arrest”advocated by some investigators in practice.On such basis,it is proposed that the time when the suspect is identified is the most reasonable starting time for the interrogation preparation.Identification,arrest and interrogation of the suspect are consistent with each other internally with the identification of suspect as the prerequisite for the suspect’s arrest and interrogation.Preparing for the interrogation at this time is beneficial after weighing between the significant impact of the investigation and evidence collection before the arrest on the interrogation of suspect,and the positive impact of arresting the suspect while conducting the peripheral investigation and collecting evidence on the interrogation of suspect.It is of great significance for the investigation organ to take the initiative of interrogation and carry out the first interrogation in a timely and effective manner.
