摘　　要：AIGC学术生产权力化给社会带来很大冲击,会引发法律风险,从而动摇学术共同体原有信任机制。出版程序是出版机构防范、控制AIGC学术生产法律风险的重要路径。出版程序的法律风险控制,需要符合正当程序的原则,但传统正当程序的要求已经难以完全适应人工智能自动决策的技术要求,必须作出相应变革。技术性正当程序理论回应这一要求,从“一个结合”“两个延伸”对传统的正当程序理论进行了改造。遵循技术性正当程序,出版机构应要求作者记录和披露AIGC学术生产的具体过程,以符合信息公开透明原则的要求;通过AIGC算法审计、同行评议使作者听取出版机构、学术共同体意见;通过作者说明理由,来实现AIGC算法的可解释性、可理解性。The power of AIGC in academic production pose significant challenges to society,potentially leading to legal risks that undermine the existing trust mechanisms within the academic community.The publication process serves as a crucial pathway for publishing institutions to prevent and control legal risks associated with AIGC in academic production.Legal risk management in the publication process must adhere to the principle of due process;however,traditional due process requirements are increasingly inadequate to meet the technological demands of AI-driven decision-making,necessitating corresponding reforms.The theory of technical due process addresses this need by transforming traditional due process through the concept of“one integration”and“two extensions”.Following the principles of technical due process,publishing institutions should require authors to document and disclose the specific processes of AIGC academic production to comply with the principles of information transparency.Additionally,authors should engage with the opinions of publishing institutions and the academic community through AIGC algorithm audits and peer reviews.Moreover,authors should provide justifications to enhance the interpretability and comprehensibility of AIGC algorithms.
