摘　　要：在数字化时代,视频监控网络广泛覆盖,视频监控数据在司法实践中的作用愈发关键。然而,因为其所具有的独特特性,在取证环节面临诸多难题,导致证据转化率不高。应以最佳证据规则为基石,在分析视频监控数据取证困境的基础上,剖析视频监控证据的特点及取证要求,系统构建视频监控数据取证程序规范,并融入新型技术应用与跨专业融合思路,创新视频监控数据取证规则,从而全面提升视频监控证据效力,推动司法实践发展。In the digital age,the extensive coverage of video surveillance networks has made video data increasingly crucial in judicial practices.However,due to its unique characteristics,the evidence collection process faces numerous challenges,resulting in a low conversion rate of evidence.Building on the best evidence rule,this study examines the difficulties in collecting video surveillance data,analyzes the characteristics and requirements of video evidence,and systematically constructs normative procedures for evidence collection.By integrating new technologies and interdisciplinary approaches,we aim to innovate the rules governing video data collection,thereby enhancing the efficacy of video evidence and promoting advancements in judicial practice.
