摘 要:在新兴技术迭代发展与公共安全面临严峻挑战的背景下,智慧警务成为警务发展的新理念与新模式,警务数据安全备受关注。数据治理趋严的监管趋势中如何实现警务数据保护与数据价值释放的合理平衡,隐私计算技术提供了技术治理领域的可行性路径。凭借化解数据安全与数据流通并行困境的特有技术优势,隐私计算应用为警务数据安全保护与高效共享流通提供了高质量、高效能、高科技的新质赋能。但在隐私计算应用过程中存在因隐私计算技术工具属性导致警务数据安全剩余风险仍存,法律定位不明引发警务数据流通归责困境,复杂融合特征造成相关个体权利保障失衡的风险。应从明确智慧警务领域隐私计算技术法律定位分层,构建隐私计算警务场景区别规制机制,推动隐私计算的多元动态协同监管应对风险,以满足智慧警务数据安全保护与充分释放警务数据要素潜能的实践需求。In the context of emerging technological iterations and severe challenges to public safety,smart policing has emerged as a new concept and model for police development,with significant attention on police data security.In light of the stringent regulatory trends in data governance,achieving a reasonable balance between police data protection and the unlocking of data value is essential.Privacy computing technology offers a viable path within the realm of technological governance.By leveraging its unique advantages in resolving the dual challenges of data security and data circulation,privacy computing applications provide high-quality,efficient,and technologically advanced empowerment for police data security protection and effective sharing.However,challenges remain in the application of privacy computing,including residual risks to police data security due to the inherent properties of privacy computing tools,legal ambiguities leading to accountability issues in data circulation,and risks of imbalanced rights protection for individuals due to complex integration characteristics.It is essential to clarify the legal positioning of privacy computing technology within the realm of smart policing,establish differentiated regulatory mechanisms for privacy computing in policing scenarios,and promote dynamic and collaborative multi-faceted supervision to address these risks.This approach aims to meet the practical demands of ensuring police data security while fully unlocking the potential of police data elements.
