摘　　要：将电子游戏规则视为著作权法意义上的表达,并据此适用著作权法对游戏“换皮”行为进行规制的司法裁判,违背了著作权法基本法理,其裁判说理存在概念偷换、模糊思想表达二分法与独创性在著作权法中的不同功能、混淆游戏规则与游戏规则的表达等问题。借鉴美国法院审理电子游戏侵权案件的经验,以便正确理解游戏规则属于不受著作权法保护这一法律思想,并据此适用反不正当竞争法来规制游戏“换皮”行为。反不正当竞争法是以行为规制的模式对游戏规则提供保护,并未违反著作权法的立法政策。通过判断在后游戏对在先游戏规则的抄袭是否超出必要限度、违反诚信原则和商业道德等综合因素,来认定游戏“换皮”行为是否构成不正当竞争并予以规制,以维护游戏产业的公平竞争秩序和促进游戏产业的长远发展。Some judicial practices have misjudged the video game rules as expression in the meaning of the copyright law,and then applied the copyright to regulate the behavior of the game clone.These judicial practices violate the basic principles of copyright law,while the reasoning of the judgement has problems such as substituting concept,blurring the function of"idea and expression dichotomy"and"originality"in the copyright law,confusing the video game rules and the expression of the video game rules.By analyzing the experience of the US courts in hearing video game infringement cases,it propose that the video game rules and the expression of video game rules should be clearly distinguished for understanding the legal nature of the video game rules.Video game rules belong to the"idea"that should not be protected by copyright law.The behavior of game clone should be regulated by the anti-unfair competition law,which is a method to protect the video game rules.The anti-unfair competition law protect the video game rules by regulating unfair competition behavior,which is not contradict to the legislative policy of copyright law.By judging these comprehensive factors to determine determine whether the game clone behavior belong to unfair competition,such as whether the imitation of the later game rules and earlier game rules exceeds the necessary limits,violates the principles of good faith and business ethics.By applying the anti-unfair competition law to video game clone maintain the fair competition order in the game industry and promote the long-term development of the game industry.
