摘　　要：最有利于未成年人原则是我国处理涉未成年人问题的根本遵循,其要求尊重未成年人的权利主体地位、坚持对未成年人的特殊、优先保护立场以及保护与教育相结合。《治安管理处罚法》对于我国未成年人司法的发展起到了重要的支撑作用,最有利于未成年人原则应当作为修订该法的基本准据,并处理好其与《预防未成年人犯罪法》的衔接问题。从最有利于未成年人原则切入对未成年人治安违法行为适用保护处分的必要性进行探讨,立法上明确两法衔接的法律适用规则,填补《预防未成年人犯罪法》关于法律适用规则的空白。由此提出整体调整《治安管理处罚法》中涉未成年人的相关规定、增加社会调查及保护处分适用的动态评估、强化检察监督以补强专门教育的监督体系的意见,构建更具有操作性的未成年人保护处分。The principle of the most favorable to minors is the fundamental guideline for dealing with problems involving minors in China,which requires respecting the status of minors as subjects of rights,insisting on the special and priority protection of minors,and combining protection and education.The Public Security Administration Punishment Law has played an important role in supporting the development of justice for minors in China,and the"principle of most favorable to minors"should be used as the basic basis for revising the Law and dealing with its connection with the Prevention of Juvenile Delinquency Law.From the"principle of what is most conducive to minors",the necessity of applying protective penalties to minors′public order offenses should be explored,and the rules for the application of the law on the convergence of the two laws should be clarified in the legislation,so as to fill in the gaps in the rules for the application of the law in the Prevention of Juvenile Delinquency Law.From this point of view,it is proposed to adjust the relevant provisions related to minors in the Law on Administrative Penalties for Public Security as a whole,to increase the social investigation and the dynamic evaluation of the application of the protection penalty,to strengthen the supervision of procuratorial supervision in order to supplement the supervision system of specialized education,and to construct a more operational protection penalty for minors.
