《学位法》学术复核程序运行的理论图景及其展开

摘　　要：《中华人民共和国学位法》第四十条创设了学术复核制度。该条款在规范内容上略显粗疏,这决定了对学术复核程序进行体系性建构十分必要。就学术复核参与主体来说,学位申请人、两级学位评定委员会、同行专家分别为启动主体、复核主体与审查主体。在学术复核的实质启动要件中,应当对“专家评阅”“答辩”“成果认定”进行准确理解,并且将有实质影响的导师意见纳入其中。学术复核应遵循学位评定分委员会资格审查、复核专家实质审查、学位评定委员会终局形式审查的三级复核程序设计。复核决定中的“最终决定”宜理解为学术复核程序上的终局。只有这样,当学术复核决定引发不授予学位的后果,且学位申请人就不授予学位提起行政复议或行政诉讼时,相关机关才可对学术评价事项进行“二次判断”。Article 40 of the Academic Degrees Law of the People's Republic of China establishes the academic review system.The content of this provision is somewhat general in its normative framework,which necessitates the systematic construction of the academic review procedure.In terms of the participants in the academic review process,the degree applicant,the two-tier degree evaluation committees,and peer experts serve as the initiating party,the reviewing party,and the examining party,respectively.Regarding the substantive initiation requirements for academic review,it is essential to accurately interpret"expert evaluation","defense",and"achievement assessment",while also incorporating the substantive input of the academic supervisors.The academic review should follow a three-tier procedural design:qualification review by the sub-committee for degree evaluation,substantive review by the review experts,and final formal review by the degree evaluation committee.The"final decision"in the review decision should be understood as the procedural conclusion of the academic review process.Only in this way,when an academic review decision results in the denial of a degree and the degree applicant initiates administrative reconsideration or litigation regarding the denial,can the relevant authorities conduct a"secondary judgment"on matters of academic evaluation.
