刑事视域下生态环境修复“刑民行”衔接适用路径研究

摘　　要：生态刑事案件涉及责任上的“刑民行”交叉,生态环境修复责任得到实务多元化适用,但也面临刑事、民事、行政责任衔接适用不畅之困境。在系统性、综合性治理的背景下,推行生态环境修复责任一体化适用,契合“体系化保护效能”的多元共治格局,融合“多元责任衔接”的能动司法导向,符合“认罪认罚从宽”的价值追求。Ecological criminal cases involve the intersection of criminal,civil,and administrative responsi⁃bilities.While environmental remediation responsibilities are diversely applied in practice,there are chal⁃lenges in the smooth connection and application of these three types of responsibilities.Against the back⁃drop of systematic and comprehensive governance,implementing an integrated approach to environmental remediation responsibilities aligns with the multi-stakeholder governance pattern of"systematized protection effectiveness,"incorporates the proactive judicial guidance of"multiple responsibilities connection,"and fits the value pursuit of"leniency for guilty pleas."
