摘　　要：[目的/意义]本研究基于专利数据对五个典型中药大品种进行对比分析,以期为我国中成药品种研究提供参考。[方法/过程]通过incoPat全球专利数据库查询专利文献,从专利申请趋势、法律状态、专利存活期、IPC分布、专利布局等多个方面研究参附注射液,桂枝茯苓胶囊,青鹏软膏,丹红注射液,注射用益气复脉(冻干)五个典型中药大品种的专利情况。[结果/结论]我国典型中药大品种专利数量不多且专利质量有待提高。研究建议,加强中医药专利人才培养,加强中药知识产权宣传和普及,提高企业自身知识产权保护意识;专利保护与中药品种保护协同,兼顾中药品种的传承与创新;重视中药专利产品布局,形成中药全生命周期多维度的专利布局策略;提高中药科研创新水平,重视专利维护和转化。[Purpose/Significance]Based on the patent data,this study made a comparative analysis of five typical Chinese medicine varieties,in order to provide reference for the research of Chinese medicine varieties.[Method/Process]The patents of Shenfu injection,Guizhi Poria capsule,Qingpeng ointment,Danhong injection and Yiqi Fumai(freeze-dried)for injection are studied from the aspects of patent application trend,legal status,patent existence,IPC distribution and patent layout through searching patent literature in incoPat global patent database.[Result/Conclusion]The number of patents of large varieties of typical Chinese medicine in China is small and the quality of patents needs to be improved.It is suggested to strengthen the training of Chinese medicine patent personnel,strengthen the publicity and popularization of Chinese medicine intellectual property rights,and improve the awareness of intellectual property protection of enterprises.The protection of patent and the protection of Chinese medicine varieties are coordinated,taking into account the inheritance and innovation of Chinese medicine varieties.Attach importance to the patent product layout of Chinese medicine,and form a multi-dimensional patent layout strategy of the whole life cycle of Chinese medicine.Improve the level of Chinese medicine research and innovation,pay attention to patent maintenance and transformation.
