林清轩与香奈儿红山茶花之争背后的专利竞争力研究

摘　　要：[目的/意义]分析山茶提取物相关发明专利申请的分布状况,研究我国重点美妆企业林清轩在该领域专利布局的优劣势,为促进国内创新主体的技术发展和竞争力提升提供一些有益启发。[方法/过程]本文以林清轩和香奈儿之间的红山茶花争议为背景,统计分析了化妆品领域中山茶提取物技术的全球和国内发明专利申请量趋势、全球申请人排名情况,比较分析了香奈儿和林清轩的发明专利申请量趋势、地域分布、技术脉络、专利质量等。[结果/结论]林清轩已经具有一定的技术发展优势和较强的专利竞争实力,但是缺少前瞻性的专利布局,启发国内创新主体需准确识别竞争对手、深度挖掘技术构成差异、合理规划专利布局,同时需全面掌控核心技术,积极促进转化运用,以提升自身的竞争实力。[Purpose/Significance]To analyze the distribution of invention patent applications related to camellia extract technology,study the advantages and disadvantages of patent layout related to Forest Cabin in this field,a key beauty enterprise in China,and provide some useful inspiration for promoting the technological development and competitiveness of domestic innovation entities.[Method/Process]The controversy over red camellia between Forest Cabin and Chanel is taken as the background,and the global and domestic trends in invention patent applications for camellia extract technology in the cosmetics field are statistically analyzed,as well as the ranking of global applicants.The trends in invention patent applications,regional distribution,technical context,and patent quality of Chanel and Forest Cabin are compared and analyzed.[Result/Conclusion]Forest Cabin has already had certain technological development advantages and strong patent competitiveness,but lacks forward-looking patent layout,which inspires domestic innovation entities to accurately identify competitors,deeply explore differences in technological composition,reasonably plan patent layout,comprehensively control core technologies,actively promote conversion and application to enhance their own competitiveness.
