数据资产化在民航领域面临的法律挑战及解决路径研究

摘　　要：随着数字化技术的迅猛发展和新质生产力、数字经济战略的提出,数据已成为推动我国经济社会转型和创造价值的重要力量。民用航空领域作为数据密集型行业,拥有海量的运营、旅客、气象等数据资源,其资产化潜力巨大。然而,民航数据资产化的进程面临着诸多法律障碍,包括但不限于数据权属界定不清、隐私保护与数据安全法规限制、跨境数据流动难题等。本文旨在探讨当前民航数据资产化过程中遭遇的主要法律障碍,并提出相应的对策建议,以促进民航数据的合法、安全、高效利用,助力行业数字化转型和智慧民航建设。With the rapid development of digital technology and the introduction of the new quality productive forces and digital economy strategies, data has become an important force for driving the economic and social transformation and the creation of value in China. As a data-intensive industry, civil aviation has massive data resources of operation, passenger, meteorology and so on and their assetization potential is huge. However, the civil aviation data assetization process faces many legal obstacles, including but not limited to unclear data tenure,privacy protection and data security regulations, cross-border data flow challenges, etc. This paper aims to discuss the main legal obstacles encountered in the assetization process of civil aviation data, and put forward corresponding countermeasures and suggestions to promote the legal, safe and efficient use of civil aviation data,and empower the digital transformation of the industry and intelligent civil aviation construction.
