跨境数据流动视阈下数字经济制度型开放的推进路径

摘　　要：积极实施数字经济制度型开放,培育数字经济领域的国际竞争优势和话语权,这是我国深化推进制度型开放的新兴议题。基于“制度”“开放”和“改革”三大维度,探讨我国制度型开放的深刻内涵。结合数字经济的概念范畴和特征属性,明确数字经济领域制度型开放的基本内容和突破重点。作为数字经济形态全球化的底层逻辑,跨境数据流动是数字经济制度型开放的核心成分,并且在其优化和发展过程中,必然产生对数字经济更高水平、深层次制度型开放的强烈诉求。立足于跨境数据流动和数字经济制度型开放之间共生互促的关联逻辑,根据数据要素“双循环”的数字经济制度型开放抓手,从更加健全和活跃的数据要素市场生态、更加完善和统一的国内统计监管制度、更加开放和广阔的数据“生成-流通-应用”产业场景、更加丰裕和全面的数据人才队伍,以及更加深刻和有效力的国际制度话语权五个方面,提出我国深化数字经济制度型开放的推进路径。Taking a positive attitude upon the digital economy institutional opening-up and forming a higher global influence and stronger competitiveness in digital economy,are the current topics for China boosting the institutional openingup.Based on three dimensions of"institution","opening-up"and"reform",this aricle gives a deeper connotation of China's institutional opening-up.The major components and breakthrough points of digital economy institutional opening-up are elaborated together with the definition and features of digital economy.As the fundamental logic of digital economic globalization,cross-border transfer of data is the core element of digital economy institutional opening-up,and calls for digital economy institutional opening-up with higher quality and deeper influence while enhancing the cross-border data transfer.According to the interaction between the digital economy institutional opening-up and cross-border data transfer,plus the "dual circulation" pattern of data factor which is the crucial gripper of digital economy institutional opening-up,implementationguidelines on further improving China's digital economy institutional opening-up are given in five aspects,including a more complete and vigorous data market,a more unified and fair statistics regulation system,a wider range and higheropennessof industril scene of data " generating-circulating-utilizing",a more suffcient and diverse data-related intllectual storage,and a more extended and stronger influence of China' s proposals.
