摘　　要：在人工智能领域,DeepSeek与OpenAI作为中美两国的杰出代表,正引领着全球下一代产业变革的浪潮。知识产权在激励创新、推动合作以及促进经济发展方面发挥着至关重要的作用,其作为国家战略性资源与国际竞争力核心要素的重要性日益凸显。在日新月异、技术迭代极快且产业路径多样的人工智能领域,要切实保护自身利益并对竞争对手产生威慑,显然要进行多层次知识产权布局,专利、商标、版权、技术秘密多种工具结合,才能为未来平等合作交流,生态共赢打下基础。本文首先通过公开信息对DeepSeek与OpenAI的知识产权布局展开研究,发现二者均采用了专利+技术秘密+其他知识产权保护手段。接着,本文从技术创新、知识产权布局、生态建设等多个维度深入剖析二者。最后,本文从技术趋势、产业策略方面为中国人工智能产业的发展提出了启示建议。In the field of artificial intelligence,DeepSeek and OpenAI,as outstanding representatives of China and the United States respectively,are leading the wave of the next generation of global industrial transformation.Intellectual property plays a crucial role in stimulating innovation,promoting cooperation and facilitating economic development.Its importance as a strategic resource for the country and a core element of international competitiveness is becoming increasingly prominent.This article will conduct an in-depth analysis of the two from multiple dimensions,including technological innovation,intellectual property layout and ecological construction,so as to provide beneficial enlightenment and suggestions for the development of China’s artificial intelligence industry.
