摘　　要：随着人工智能技术的快速发展,涉人工智能犯罪发生的频率越来越高,该类案件也越来越复杂。根据人工智能自主性不同,可以将涉人工智能犯罪划分为涉辅助型人工智能犯罪、涉半操控型人工智能犯罪、涉自主型人工智能犯罪和涉强人工智能犯罪。根据不同类型犯罪的特点,可以厘清相应的刑事责任主体,也可以合理地进行责任分配。此外,面对技术的快速发展,刑法和其他法律也应当适时做出相应的调整。可以通过推动专门的人工智能立法,适时增设非法研发、制造人工智能罪、滥用人工智能罪和人工智能事故罪的方式,来规避新的社会风险。With the rapid development of artificial intelligence technology,the frequency of crimes involving artificial intelligence is increasing,and such cases are becoming more and more complex.According to the different autonomy of artificial intelligence,AI-related crimes can be divided into auxiliary AI crimes,semi-manipulative AI crimes,autonomous AI crimes and strong AI crimes.According to the characteristics of different types of crimes,the corresponding subject of criminal responsibility can be clarified,and the responsibility can be reasonably distributed.In the face of the rapid development of technology,criminal law and other laws should also make corresponding adjustments in time.New social risks can be avoided by promoting special artificial intelligence legislation and timely establishing illegal research,development and manufacturing of artificial intelligence crimes,artificial intelligence abuse crimes and artificial intelligence accident crimes.
