摘　　要：总体国家安全观是习近平法治思想的重要内容,亦强化了刑法的安全价值理念。近年来,我国刑事立法和刑事司法积极践行了总体国家安全观。以刑事立法为载体,总体国家安全观推动了积极预防性刑法观的形成,塑造了“人民安全本位”范式。在总体国家安全观指导下,刑事立法在政治安全、公共安全、经济安全、社会安全、网络安全、生态安全等领域积极进行了回应,修改和增设了诸多条款,优化了刑法对总体国家安全观的表达。总体国家安全观还指导了我国各重点领域国家安全法律规范体系的形成,并实现了与我国刑法条款的有机衔接,强化了刑法保障法的功能。我国刑事司法解释和司法实践也秉持总体国家安全观,确保了刑事司法解释的内部自洽和刑事司法中安全与自由的价值平衡。The holistic approach to national security has reinforced the value of security in criminal law, and the criminal legislations as well as the judiciary are fulfilling that holistic approach. As embodied in criminal legislations, the holistic approach fosters the formation of the active-defensive notion in criminal law. Under the guidance of the holistic approach, the criminal legislations have taken initiatives to respond to the fields such as political security, public security, economic security, social security, network security, ecological security, in amendments or additions of criminal provisions, to optimize the expression of criminal law to the holistic approach. Meanwhile, the holistic approach offers a directive to the national security legislative systems in the main fields;the criminal law tends to link to relative provisions in national security laws to realize its safeguard role in the overall legal system. The criminal judicial interpretations and judiciary should adhere to the holistic approach, in order to ensure the internal coherence within judicial interpretations and the balance between security and freedom in the criminal judiciary;the present misdemeanor governance is the key to the optimal expression of the holistic approach in the judiciary.
