摘　　要：国内妨害国(边)境管理违法犯罪的分散型侦查体制是近年才形成的,在运行中取得了显著成效,但也暴露出了线索移交不畅、案件流失等诸多问题。表面上解决上述困境只需要赋予边检部门侦查权,但深层次的解决办法在于构建集中型的侦查体制。移民管理机构实行集中型警察体制,但未应然地构建出集中型侦查体制,根源在于国内整体分散型的侦查体制。出入境管理的行政权,随移民管理机构的整合而趋于集中,但是侦查权并未随之集中。在国内整体为分散型侦查体制的大背景下,建构妨害国(边)境管理犯罪的集中型侦查体制,需要面向集中型侦查体制的优势、面向侦查权整合集中的新理念、面向法律的限度,在“条块结合”的总的框架下,坚持“条块结合以条为主”的运行模式,不断完善妨害国(边)境管理犯罪的集中型侦查体制。The decentralized investigation system against criminal cases of national border management obstruction has gradually taken shape and has achieved remarkable results in operation.However,it has also exposed many problems,such as inefficiencies in clue transfer and loss of cases.On the surface,it is only necessary to give the border inspection department investigatory power to solve the above challenges,but a deeper and more fundamental solution lies in establishing a centralized investigation system.Immigration administration agencies implement a centralized police system,but they have not inherently developed a centralized investigation system,which is rooted in the overall decentralized investigation system in China.The administrative authority over exit-entry administration tends to be centralized following the integration of immigration administration agencies,but the criminal investigatory power has not been correspondingly centralized.Under the background of the decentralized investigation system in China as a whole,the construction of the centralized investigation system for crimes of national(border)management requires a multidimensional approach.It includes leveraging the advantages of the centralized investigation system,embracing new concepts of the integration of investigatory power,and ensuring compliance with legal constraints.Within the overarching framework of“integrating vertical and horizontal management”,the operational model should prioritize vertical management while maintaining a balance between the two.This approach will facilitate the continuous refinement and improvement of the centralized investigation system against criminal cases of national border management obstruction.
