摘 要:随着跨部门协同成为当代行政活动中的一种常态,构建一种更具整体性和全局性的合法性判断标准以适应协同特征变得尤为必要。现有理论,尤其是行政行为违法性继承理论,在应用于合法性判断时,暴露出在理论预设、适用场域、行为形式以及关联关系考察等方面的局限性。因此,借助行政过程论来深化对跨部门协同的学理认知,并在此基础上构建合法性判断的新标准,则具有一定可行性。行政过程论以其全面考察与动态考察两种核心方法,可以把跨部门协同的法治要素划分为基础要素与关联性要素。在此学理认知基础上,构建以基础要素合法性、关联性要素合法性及衡量机制为核心的三阶合法性判断标准。As interdepartmental collaboration becomes a standard feature of contemporary administrative governance,it is increasingly imperative to establish a more holistic and comprehensive standard for legitimacy assessment.Existing theories,particularly those of the inheritance of illegality in administrative actions,exhibit limitations when applied to legitimacy assessment,particularly in terms of theoretical assumptions,scope of application,forms of administrative action,and the examination of interrelated factors.This article argues that employing the administrative process theory to deepen the theoretical understanding of interdepartmental collaboration provides a viable path toward constructing a new legitimacy assessment framework.By incorporating the core methodologies of comprehensive and dynamic examination,administrative process theory enables the categorization of rule-of-law elements in interdepartmental collaboration into fundamental and relational components.Based on this theoretical foundation,a three-tier legitimacy assessment framework can be established,centering on the legality of fundamental elements,the legality of relational elements,and the development of an evaluation mechanism.
