摘　　要：在综合行政执法改革中,构建行业监管部门与综合行政执法部门之间的监管与执法协作体系是改革的核心内容之一,具有实质性推进整体政府理论研究的积极意义,同时有效回应了改革带来的部门(层级)间协作需求。在当前的改革实践中,既有的“动员型协作”模式与“策略型协作”模式系临时性、情境化的机制嵌入,难以常态化破解监管与执法的协作难题。基于“制度型协作”的模式理念,监管与执法协作的实质在于构建程序化的协作流程,打造一个能够反映行政执法权力运行全过程的监管与执法协作体系。为此,需要围绕行政执法的案件分流、初查合作、立案取证、行政处罚、复议诉讼等各个环节展开协作体系构造。基于非对称性执法资源依赖结构的现实困境,考评体系、数字赋能、争议协调解决等方面的配套性措施亦不可或缺。One of the core contents of the comprehensive administrative law enforcement reform is to establish a supervision and law enforcement collaboration system.It has significant positive implications for advancing whole government theoretical research,and deeply responds to the practical needs for interdepartmental collaboration brought about by reforms.In the current reform practice,the existing models of“mobilization based collaboration”and“strategic collaboration”are temporary and contextualized mechanisms embedded,making it difficult to solve the difficulties of supervision and law enforcement collaboration on a regular basis.Based on the concept of“institutional cooperation”,the essence of supervision and law enforcement cooperation lies in building a procedural cooperation process and creating a supervision and law enforcement cooperation system that can comprehensively reflect the operation of administrative law enforcement power.For that,it is necessary to further enter the administrative law enforcement process through typical cases,and to carry out collaborative construction around various links such as case diversion,preliminary investigation cooperation,case filing and evidence collection,administrative penalties,and reconsideration litigation.The practical difficulties of supervision and law enforcement based on the asymmetric dependence structure of law enforcement resources require complementary explorations in evaluation systems,digital reform,dispute coordination and resolution.
