摘　　要：现行环境法体系的结构性问题阻碍了环境法体系的现代化,需要通过提升环境法体系的融贯性加以解决。作为问题导向的领域法,融贯的环境法体系不仅要符合形式理性,而且应遵循环境保护事务规律要求的效用理性。按照双重理性的要求,环境法体系的构建需追求逻辑的连贯性、价值的融贯性与目标的融贯性,关注不同环境法规范的内在系统关联问题。采用立法与法律实施互动的视角审视环境法体系,可以发现现行环境立法未能为执法与司法提供融贯的法律论证逻辑前提、价值判断的指向标、实现规制目标的协调器。为弥补融贯性缺陷,立法者应当借助生态环境法典编纂契机,在解释、分类、整理现有环境法规范的基础上,运用体系结构的网络化、概念类型的多元化、政策原则的法律化、法律规范的关联化等技术方法构建融贯的环境法律体系。The structural drawbacks of the current environmental law system are impeding its modernization,and should be addressed by improving the coherence of the environmental law system.As a problem-oriented legal field,a coherent environmental law system should not only conform to the formal rationality of law,but also follow the functional rationality of environmental protection.Therefore,a coherent environmental law system should have the features of logical consistency,value coherence and objective coherence,focusing on the internal connection between different environmental rules.The establishment of a coherent environmental law system demands cooperation between legislators and implementers.From this perspective,the current environmental law system fails to provide coherent logical premises for legal argument,coherent legal basis for value judgment and coherent coordinators of regulatory objectives.To compensate for the lack of coherence,legislators should enact an environmental code by interpreting,classifying and sorting out existing environmental rules.The enactment of an environmental code should adopt legislative techniques including network-like structure,diversified concept types,codified legal principles,and objective-related legal rules.
