党内法规话语嵌入国家法律话语的效应及限度

摘　　要：随着党的领导的不断加强,党内法规话语嵌入国家法律话语的情形日益常见。党内法规话语嵌入国家法律话语由权力运作、党政关系、规范基础、话语融合等多方因素推动而成,并产生了塑造国家法律规则、规范公权力运行、厚植公职人员角色意识等效应。但是,党内法规话语嵌入国家法律话语也产生了法律效力“内卷化”、法律稳定性被冲击、公职人员角色冲突加剧等问题。欲有效应对这些问题,就应当明确党内法规话语嵌入国家法律话语系统的边界与事项范围、推动党内法规同国家法律的衔接协调、厘定国家机关的自由裁量基准、理顺公职人员的多重角色关系、完善党内法规话语传播机制,进而促进中国特色社会主义法治话语体系结构的均衡发展。With the continuous strengthening of the Party’s leadership,it is becoming increasingly common for the discourse of the intraparty rules and regulations to be embedded into the national legal discourse.The embedding of the discourse of the intraparty rules and regulations into national legal discourse is driven by various factors such as power operation,party government relations,normative foundation,and discourse integration,and has produced effects such as shaping national legal rules,regulating the operation of public power,and cultivating the role awareness of public officials.However,the embedding of the“discourse”of the intraparty rules and regulations has also led to issues such as the internalization of national legal effectiveness,the impact on the stability of national laws,and the intensification of role conflicts among public officials.This has also raised higher requirements for the sound dissemination mechanism of the discourse of the intraparty rules and regulations.To this end,it is necessary to clarify the power boundaries and scope of matters embedded in the discourse of Party regulations,promote the connection and coordination between the intraparty rules and regulations and the national laws,determine the discretionary standards of state organs,streamline the multiple role relationships of public officials,and improve the dissemination mechanism of Party regulations.Only in these ways can we clarify the boundaries of intraparty rules and regulations embedded in national legal discourse and promote the structural balance of the socialist rule of law discourse system with Chinese characteristics.
