法哲学作品观视阈下AIGC的作品定性再分析

摘　　要：在司法判决、学术文献中,人工智能生成内容作品肯定说对著作权法核心概念“作品”“作者”“创作”的不同解读,促使我们向深层次挖掘问题根源,探寻法理基础。历史上形成的版权体系的作品财产观、作者权体系的作品人格观经不起实践和理论检验,存在脱离社会现实、混淆法律概念等缺陷。作品的法哲学本质应是人类智力创作成果。人工智能生成内容作品肯定说主张的作品外观主义不符合著作权法的底层逻辑;介入、控制标准颠覆了合作作者的本质;人工智能生成内容与人类作品平等保护论加剧了“劣币驱逐良币”等负面效应。基于“人类智力创作成果”的作品本质,人机互动是人机各司其职,而非人机合作创作。人工智能生成内容是人工智能自主生成的算法创作成果,属于人工智能制品,与人类作品本质不同,法律应给予不同的制度评价,进行区分保护。The affirmative opinion on the copyrightability of AI-generated content(AIGC)in judicial decisions and academic literature involves totally different interpretations of the core concepts in copyright law,such as"work""author"and"creation",which prompts a deeper investigation into the root causes and legal foundations of the issue.Historically,both the property-oriented view of works in the copyright system and the personality-oriented view in the author's rights system,fail to withstand practical and theoretical scrutiny.They exhibit flaws such as detachment from social reality and confusion of legal concepts.The nature of works in legal philosophy should be the result of human intellectual creation.The appearance-based approach advocated on the copyrightability of AIGC does not align with the underlying logic of copyright law;the intervention and control standard undermines the essence of co-authorship;and the equal protection of AI-generated and human-created works exacerbates negative effects such as"bad money driving out good"phenomenon.Given that the essence of works is a product of human intellectual creation,human-machine interaction should be understood as each playing its respective role rather than collaborative creation.AIGC represents algorithmically generated outputs by AI,which are AI products distinct from human works in essence.The law should provide different institutional evaluations and differentiated protection for them.
