入监未减刑罪犯构成与原因解析及矫正策略研究——以华东某省Y监狱入监4年以上相关罪犯为例

摘　　要：华东某省Y监狱2024年2月底在册罪犯中,入监后超过4年未减刑罪犯以及入监后减刑间隔时间超过4年的罪犯群体共计75人。利用访谈法、综合分析法、数理统计法等深入剖析他们犯罪情况多维特点,归纳分析他们超过4年未能申报减刑存在的原判财产性判项未履行或未全部履行、日常改造中发生多次小的违纪违规或者重大违纪违规、无法适应正常的社会生活主动申请放弃申报减刑假释等主客观多层面原因。系统探寻健全检法监三方协作机制、推动财产性判项依法履行,完善教育矫正激励机制、提高罪犯改造积极性,落实精细化管理措施、着力做好罪犯分类分级管控工作,创新罪犯矫正新路径、大力开展罪犯心理矫治工作,切实开展罪犯职业技能培训、着力助推刑罚执行一体化工作等相应的矫正策略,为全力提升罪犯矫正效能和监狱治理水平提供相应的参考,着力助推监狱高质量发展,为平安监狱建设做出积极贡献。As of the end of February 2024,among the registered prisoners in Y Prison in a province of Eastern China,there were 75 prisoners who had not received a sentence reduction for over four years after admission or whose interval between sentence reductions exceeded four years.Using methods such as interviews,comprehensive analysis,and mathematical statistics,this study delves into the multidimensional characteristics of their criminal situations and summarizes the subjective and objective reasons for their failure to apply for sentence reduction within four years.These reasons include unfulfilled or partially fulfilled property-related judgments from their original sentences,multiple minor or major disciplinary violations during daily rehabilitation,and voluntary abandonment of applying for sentence reduction or parole due to an inability to adapt to normal social life.The study systematically explores corresponding correction strategies,such as improving the tripartite collaboration mechanism among prosecutors,courts,and prisons,promoting the lawful fulfillment of property-related judgments,enhancing educational correction incentive mechanisms to increase prisoners'rehabilitation motivation,implementing refined management measures to strengthen classified and hierarchical control of prisoners,innovating new paths for prisoner correction by vigorously developing psychological correction programs,and effectively conducting vocational skills training to advance the integration of penalty enforcement.These strategies aim to provide references for improving the effectiveness of prisoner correction and prison governance,thereby contributing to the high-quality development of prisons and making positive contributions to the construction of safe prisons.
