摘　　要：首先,对中国档案数据出境的法律规制现状进行了梳理,分析了《中华人民共和国档案法》《中华人民共和国数据安全法》等现行法律法规中关于档案数据跨境流动的相关规定,明确其法规监管体系;其次,深入探讨了我国在档案数据出境法律规制方面存在的主要问题,包括法律体系不完善、监管机制不足及国际合作要素的缺乏等;最后,提出了针对这些问题的提升对策,主要包括完善法律框架、加强监管与治理机制、加强国际合作与对接全球标准等。Firstly,the paper combs through the current status of China's legal regulations of archival data exit,analyzes the relevant provisions on cross-border flow of archival data in the current laws and regulations such as the Archives Law and the Data Security Law,and clarifies its legal supervision system.Secondly,it discusses the main problems in China's legal regulations of archival data exit deeply,including imperfection of the legal system,insufficiency of the supervision mechanism and the lack of international cooperation elements.Finally,it puts forward countermeasures to solve these problems,which mainly include improving the legal framework,strengthening the supervision and governance mechanism,enhancing international cooperation and docking with global standards.
