党内法规备案审查的制度演进与治理转型——基于历史制度主义的分析视角

摘　　要：党内法规备案审查是中国共产党提升党内法规建设质量,维护党中央权威与法治统一的重要制度举措。党内法规备案审查制度建设呈现出从功能性向规范性转向的演进脉络和趋势。历史制度主义提供了分析这一制度演进的理论视角与框架。党内法规备案审查的制度演进是“环境”与“传统”共同推动的结果。改革开放提供了制度演进的动力,塑造了推动党内法规备案审查制度发生实质性转变的社会环境基础;路径依赖对制度演进形成了内在约束,功能性党内法规备案审查制度的目标与传统也被部分吸纳到规范性党内法规备案审查制度中。党内法规备案审查制度演进蕴含着从政治治理到政法协同治理、从综合治理到专门治理、从法制主义到法治主义的转型逻辑。The filing review for intra-Party regulations is an important institutional measure of the Communist Party of China(CPC)to improve the quality of intra-Party regulations and maintain the authority of the Party Central Committee and the unity of the rule of law.The construction of the filing review system for intra-Party regulations shows a trend of institutional evolution from functionality to normalization.Historical institutionalism provides a theoretical perspective and framework for analyzing the evolution of this system.Such institutional evolution is the result of the functions of“environment”and“tradition.”The reform and opening up empowers the system evolution,and shapes the social environment basis for the substantial transformation of the filing review system for intra-Party regulations.Path dependence has formed internal constraints on the evolution of the system,and the goal and tradition of the functional filing review system for intra-Party regulations have also been partially incorporated into the normative filing review system for intra-Party regulations.The institutional evolution contains the transformation logic from political governance to political and legal collaborative governance,from comprehensive governance to specialized governance,and from legalism to the rule of law.
