基层社会治理法治化视域下人民调解制度改革探析

摘　　要：人民调解是马克思主义指导下对我国传统调解进行社会主义改造形成的解决民间纠纷的必要措施。40余年来国家和地方对人民调解的改革探索以组织权威性、人员权威性和结果权威性为导向,在一定程度上促进了人民调解事业的发展。但同时,人民调解随着社会发展呈现出过度行政化与司法化、城乡人民调解组织设置不均衡、城乡人民调解组织建设同类化、人民调解的便利性及可识别性不够等问题,未来人民调解应以人民群众需要为核心,从规范政府参与人民调解过程、统一调解制度框架、优化城乡调解组织设置与建设、加强人民调解信息化和品牌化建设等方面来优化发展人民调解制度。People's mediation is a necessary measure to resolve civil disputes formed by the socialist transformation of traditional mediation under the guidance of Marxism in China.Over the past 40 years,the reform and exploration of people's mediation by the state and local governments have been guided by organizational authority,personnel authority,and result authority,which has promoted the development of the people's mediation.However,people's mediation has shown problems such as excessive administrative and judicial development,uneven establishment and homogenization construction of urban and rural people's mediation organizations,and insufficient convenience and recognizability of people's mediation.In the future,people's mediation should be centered on the needs of the people,standardize government's participation in the people's mediation process,unify the mediation system framework,optimize the establishment and construction of urban-rural mediation organizations,strengthen the informationization and branding of people's mediation,and other measures to optimize the development of the people's mediation system.
